REGULATION

To amend ONTARIO REGULATION 213/91

Made under the

OCCUPATIONAL HEALTH AND SAFETY ACT

 

  

3. Section 22 of Ontario Regulation 213/91 is revoked and the following substituted:

 

Headwear

22. (1) Protective headwear shall be readily available for the personal use of each worker on a project.

 

(2) Every worker who may be exposed to a hazard to his or her head while on a project shall wear protective headwear.

 

(3) Protective headwear shall meet the requirements for Class E protective headwear under the standard, CAN/CSA-Z94.1-92 (R1998)  Industrial Protective Headwear, or it shall meet the requirements of another standard that affords at least equal protection for the health and safety of workers

 

4. Section 23 of the Regulation is revoked and the following substituted:

 

Footwear

23. (1) Protective footwear shall be readily available for the personal use of each worker on a project

 

(2) Every worker who may be exposed to foot injury while on a project shall wear protective footwear.

 

(3) Protective footwear shall consist of safety shoes or safety boots and shall meet the requirements of Grade 1 Protective Footwear under CAN/CSA-Z195-M92 Protective Footwear.

 

(4) On and after [specific date one year later], the safety shoes or safety boots referred to in subsection (3) shall be equipped with an electric shock resistant sole.

 

5. Section 24 of the Regulation is revoked and the following substituted:

 

Eye protection

24.(1) Eye protectors shall be readily available for the personal use of each worker on a project.

 

(2) Every worker who may be exposed to eye injury while on a project shall wear eye protectors.

 

(3) On and after [specific date one year later], eye protectors shall meet the requirements under  CAN/CSA-Z94.3-00 Industrial Eye and Face Protectors.

 

6. Section 25 of the Regulation is revoked and the following substituted:

 

Skin protection

25. A worker while on a project shall use protection adequate in the circumstances to protect the worker’s skin from contact with,

 

(a)                 a hazardous substance in the form of gas, fumes, liquid, mist or dust:

(b)                 an object that may puncture, cut or abrade the skin:

(c)                 a hot object, hot liquid or molten metal;

(d)                 radiant heat; or

(e)                 ultraviolet A or ultraviolet B radiation.

 

7. The Regulation is amended by adding the following sections:

 

Hearing protection

25.1 (1) Hearing protection that is adequate in the circumstances to protect a worker from hearing loss shall be readily available for the personal use of each worker on a project.

 

(2) A worker who may be exposed to a risk of hearing loss while on a project shall wear hearing protection adequate to protect the worker and that meets the requirements of CSA Standard Z94.2-94, Hearing Protectors.

 

Respiratory protection

25.2 (1) If it is not reasonably possible to provide natural or mechanical ventilation in circumstances where a worker may be exposed to a hazardous substance by inhalation or from a lack of oxygen, respiratory equipment shall be provided to and used by a worker on a project and shall be adequate in the circumstances to protect the worker.

 

(2) Respiratory equipment shall be certified by the United States National Institute for Occupational Safety and Health.

 

(3) A worker who uses respiratory equipment shall be adequately trained in the care, use and maintenance of the equipment in accordance with the instructions of the manufacturer.

 

(4) The respiratory equipment shall be cared for, used and maintained in accordance with the instructions of the manufacturer or, if instructions are not available, in accordance with CSA Standard Z94.4-93 (R1999), Selection, Use and Care of Respirators.
